Civil Litigation

Civil cases are disputes that turn into a lawsuit.  Cases can be handled out of court through arbitration, mediation, or case dismissal - or in court during a trial.

Types of civil cases:

In California, medical negligence occurs when a professional deviates from the standard of care when treating a patient. Examples of these acts:


  • Misdiagnosing, failing to diagnose or delaying a diagnosis

  • Incorrect medication and/or dosages

  • A mistake during surgery. 

Victims should be aware if deciding to file a lawsuit, there is a statute of limitations. In California Courts, you have the shorter of one year from either the date they knew or should have known about the injury to file the claim, or three years from the date the incident actually took place. State law also dictates when a health provider is going to be sued, the plaintiff must give the entity 90 days notice prior to initiating the claim.

Law does make a exception concerning minors.  These claims generally must be filed within three years of the incident.  However, if the victim is younger than 6, the claim should be initiated within three years or before the child turns 8, whichever is the longer timeframe.
